DISTANCE SALES CONTRACT

1. PARTIES

This contract is executed between the parties specified below under the terms and conditions stated herein.

By accepting this agreement, the BUYER acknowledges that if they approve the order, they are obliged to pay the order amount and any additional fees such as shipping and taxes, and that they have been informed of this obligation in advance.

2. DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings ascribed below:

MINISTER: Minister of Customs and Trade
MINISTRY: Ministry of Customs and Trade
LAW: Law No. 6502 on the Protection of Consumers
REGULATION: Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188)
SERVICE: Any subject of consumer transactions other than the supply of goods, performed or promised to be performed in exchange for a fee or benefit
SELLER: The company offering goods to consumers within the scope of its commercial or professional activities, or acting on behalf of or on account of the person offering such goods
BUYER: The natural or legal person acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes
SITE: The internet website owned by the SELLER
ORDERING PERSON: The natural or legal person who places an order through the SELLER’s website
PARTIES: The SELLER and the BUYER
CONTRACT: This agreement concluded between the SELLER and the BUYER
GOODS: Any movable property or intangible goods such as software, sound, images, and similar digital content prepared for use in an electronic environment

3. SUBJECT

This Contract regulates the rights and obligations of the parties pursuant to the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) specified below, ordered electronically by the BUYER via the SELLER’s website.

All listed and published prices are sales prices. Published prices and commitments remain valid until updated or changed. Time-limited prices are valid only for the specified duration.

7. PRODUCT INFORMATION

7.1. The basic characteristics (type, quantity, brand/model, color, number) of the goods or services are published on the SELLER’s website. If a campaign is organized by the SELLER, you can review the relevant product features during the campaign period.

7.2. The prices listed and announced on the site are sales prices and include taxes.

Invoice Delivery: The invoice will be delivered to the invoice address along with the order during delivery.

9. GENERAL PROVISIONS

9.1. The BUYER declares that they have read and are informed of the basic characteristics of the product(s), the sales price, payment method, and delivery conditions on the SELLER’s website, and that they have given the necessary confirmation electronically.

9.2. Each product covered by the contract shall be delivered to the BUYER or the person/institution designated by the BUYER within a maximum of 30 days, depending on the distance of the BUYER’s location, unless otherwise stated in the pre-information on the site.

9.3. The SELLER undertakes to deliver the product completely, in accordance with the specifications in the order, together with warranty certificates, user manuals, and all relevant documents, and to act in accordance with the principles of honesty, accuracy, and due diligence.

9.4. The SELLER may, with the BUYER’s approval, supply a product of equal quality and price before the contractual performance period expires.

9.5. If fulfillment of the order becomes impossible, the SELLER shall notify the BUYER in writing within 3 days and refund the full amount within 14 days.

9.6. If the product price is not paid or the payment is canceled in the bank records, the SELLER’s obligation to deliver the product ceases.

9.7. If the product price is not received by the SELLER due to unauthorized use of the BUYER’s credit card by third parties, the BUYER shall return the product to the SELLER within 3 days, with shipping costs borne by the SELLER.

9.8. In the event of force majeure preventing or delaying delivery, the SELLER shall inform the BUYER, who may request cancellation, replacement, or postponement of delivery. Refunds will be processed within 14 days, and any delay in credit card refunds due to bank procedures shall not be the SELLER’s responsibility.

9.9. The SELLER may contact the BUYER via mail, e-mail, SMS, or phone for marketing, notification, or other purposes. Acceptance of this agreement constitutes consent for such communication.

9.10. The BUYER must inspect the product before receiving it; damaged or defective goods should not be accepted. Products accepted from the courier are deemed intact. If the right of withdrawal is exercised, the product must be unused and the invoice returned.

9.11. If the cardholder and the BUYER differ or a security issue is detected, the SELLER may request proof of identity or ownership of the card. If not provided within 24 hours, the SELLER reserves the right to cancel the order.

9.12. The BUYER guarantees that the personal information provided during registration is correct and agrees to indemnify any loss incurred by the SELLER due to false information.

9.13. The BUYER undertakes to comply with all applicable laws when using the SELLER’s website and accepts full responsibility for any violations.

9.14. The BUYER shall not use the website for unlawful, immoral, or harassing purposes, nor engage in activities such as spam or malware distribution.

9.15. The SELLER’s website may contain links to third-party sites for convenience. These do not constitute endorsement, and the SELLER assumes no responsibility for their content.

9.16. Members who violate any provision of this agreement are personally liable for resulting legal and criminal consequences and shall indemnify the SELLER for all damages.
